An ICE officer shot and wounded a man in New York City’s Marble Hill neighborhood Thursday afternoon. Mayor Zohran Mamdani said early reports indicated agents surrounded the man and a 5-year-old child in his car before firing multiple rounds. The child was believed to be physically unharmed. [1]
I spent twenty years as a cop, and I’m reading this closely for what happened before the first shot. What threat did the officer believe he was facing, and did the agents know a child was in that car?
DHS has acknowledged that an officer fired during an enforcement operation. Its public account has not explained what prompted the officer to shoot. [5]

What happened in Marble Hill
The shooting happened around 4 p.m. near West 225th Street and Marble Hill Avenue. Marble Hill is legally part of Manhattan, although it sits on the Bronx mainland, which accounts for differing borough labels in early coverage. [2][4]
ABC7 reported, citing city officials, that an ICE agent fired through the front windshield of an SUV while a child was in the back seat. Witnesses described a busy street with schoolchildren and commuters nearby. [2]
The witness accounts are still being assembled. Orlando Perez told Gothamist he saw people wearing vests fire at a car as it tried to drive away, then remove a child. Another nearby resident told the outlet he heard seven shots. A restaurant employee interviewed by The Associated Press estimated three or four. Those accounts do not establish an exact shot count or a complete sequence of events. [4][5]
The NYPD said its officers were neither involved in the shooting nor present when it happened. Local officers subsequently responded. AmNewYork reported that they provided aid and transported the wounded man in a police vehicle to NewYork-Presbyterian Allen Hospital. [3][6]
DHS separately said ICE officers immediately provided medical assistance. The timing and sequence of that assistance have not been independently established by XVOA. [10]
The man’s condition and the child’s whereabouts
The NYPD said the wounded man was conscious and receiving medical attention. News 12 reported that his injuries were not considered life-threatening. His name had not been publicly identified in the reporting reviewed for this update. [3][6][7]
At an evening news conference, Rep. Adriano Espaillat said he had spoken with the family and that the child was in their custody, according to ABC7. Espaillat also said ICE agents prevented him from visiting the wounded man in the hospital. [2]
The child’s relationship to the man has not been established in the sources reviewed here. This report therefore does not identify the man as the child’s father.
What DHS is saying
DHS described the operation as an attempt to arrest a Dominican national. The agency alleged a previous grand larceny conviction, other arrests involving assault, robbery, drugs and weapons, and associations with the Trinitarios gang. DHS also said the NYPD arrested him on December 7, 2023, and released him several days later. [10]

DHS blamed New York’s sanctuary policies for requiring officers to make arrests in the community. Its statement did not specify what threat the officer perceived at the moment he fired. [10]
The FBI’s New York Evidence Response Team responded to support DHS, according to News 12. DHS also said Homeland Security Investigations personnel were at the scene. [7][10]
Officials demand answers as protests grow
Mamdani said he had placed a call to President Donald Trump and intended to demand an end to ICE enforcement operations in the city when they spoke. His statement did not establish that a conversation had already occurred. [1]
“I will not stand by while ICE agents terrorize our communities,” the mayor said. He ended his statement: “Abolish ICE.” [1]
Gov. Kathy Hochul called for a transparent federal accounting. Public Advocate Jumaane Williams urged the city to release footage and other information collected from the scene. [6][8]
Protesters gathered at the shooting scene and later near the hospital. The Associated Press reported that some demonstrators clashed with police as officers established barriers to keep access open for ambulances and other vehicles. Police made arrests; the report did not provide a final total. [4]
A dispute over nearby ICE activity preceded the shooting
On October 5, eight elected officials wrote to Kingsbridge Associates about reports that ICE was using the Target parking lot at 40 West 225th Street as an enforcement staging area. They asked whether that use had been authorized and urged the responsible entity to end any authorization. [9]
Target told Gothamist it had no agreement with ICE or other immigration enforcement agencies and said the shooting did not occur on or adjacent to its property. A connection between the reported parking-lot activity and Thursday’s shooting has not been established. [5]
What remains unanswered
The sources reviewed for this update do not establish whether the man was armed, whether anyone faced an immediate threat, what commands agents gave, or whether agents knew a child was inside before firing. Perez’s account of a car trying to leave does not resolve its speed, direction or proximity to officers.
The exact number of rounds, the number of officers who fired, and a complete account of the man’s injuries also remain unresolved. Footage capturing the full encounter, including the moments before the shooting, will be important evidence.
The central question remains: What happened in the seconds before an officer fired into a vehicle containing a man and a child?
