The criminal charge disappeared. The Air Force investigation remains. Now America has to decide what constitutional conscience means inside a military built on command.

As Pictator and you discussed above, I too have deep concerns for the true independence of the military courts (as well as the civil courts) in these current days. There was a reason for the military leader to dismiss so many JAG officers and judges at the very beginning of the regime’s term and that reason is becoming clearer every day. To announce at a meeting of all the top brass that the military would no longer follow the rules of law was shocking and shameful. And now to say it is unlawful to even question the Constitutionality of any questionable order is beyond the pale. My heart is broken as we travel through these very difficult and dangerous times. Thank you again for your careful analysis and presentation of the facts.

The attack on the military by all the resources of the reactionary right have been impossible to handle within constitutional constraints.
You put your finger on the real test Piscator. The question now is whether the military gets to follow its own process, or whether the same political command structure Watson challenged reaches down and bends the outcome.
And Pictator your second point matters just as much: the civilian system keeps exporting its constitutional failures downward, then expects the military to absorb the damage quietly. That is the fracture I am watching too.
